Wholesale Terms and conditions
These Terms of Sale are a legally binding agreement between you and us and govern your purchase of any products from us. You agree to comply with these Terms of Sale and all additional terms and conditions governing access to and use of InsectsInResin.com (the “Website”)
Binding agreement
By purchasing any products from us, you understand and agree that you have read, understood and agreed to all of the provisions of these terms of sale and all other agreements, Policies and terms and conditions. If you do not understand or agree, you should not purchase anything from the website.
Policies & MAP (Minimum Advertised Price)
In an effort to reduce possible retail competition for you and ourselves, we have implemented the following MAP (Minimum Advertised Price) policies. Wholesale account holders are not permitted to sell InsectInResin.com products on 3rd party marketplace sites such as: Etsy, Amazon, Ebay, Home Depot, Lowes, Walmart, Wayfair, Ebay and Overstock. Selling on your own website is permitted. (the site which has been registered and approved by InsectsInResin.)
Wholesale customers may not advertise any InsectsInResin products for a price that is less than what is shown on the InsectsInResin site as retail. There are occasional exceptions, as we understand that discount sales and promotion might be a part of your business strategy. Items within brick and mortar locations can be priced at your discretion.
We take our business relationship with our wholesale customers seriously. To minimize local and reginal competition, Insect In Resin products are not sold to distributors.
Shipping
Wholesale products shipping and handling cost is calculated by weight. This price will be calculated and shown in the cart prior to purchase.
Wholesale products are available for purchase via the InsectsInResin.com site only. We do not sell wholesale directly in shop.
Returns and Cancelations
Orders can be canceled as long as they have not yet been shipped. Once shipped, cancelation is not available. We guarantee a high quality product. We will refund or replace any product that is received damages or broken. There are no returns on products purchased wholesale. If a product is received damaged, you must contact us with 3 days of receiving the order.
Affiliation and Laws
It is understood that InsectsInResin and its members and employees are in NO way associated with USFWS (U.S. Fish and Wildlife Services) CPB (Customs and Border Patrol) the CDC or any other government agency. Laws pertaining to the sale of wildlife can vary from location to location and it is the responsibility of you (the wholesale customer) to do their research in regard to local sale of wildlife.
Copyright and intellectual property
All images and content are copyright and or intellectual property of InsectsInResin.com and Oddities Inc. The usage or copying of images and or product description is not permitted. The website and all content thereof are exclusive property. The copyright and all other rights to which are owned by us.
Limitation of liability
To the maximum extent permitted by applicable law, none of us, nor any of their respective officers, directors, members, partners, employees or agents (each, a “related party”) shall be liable for punitive, consequential, incidental, exemplary, indirect, or special damages (including damages for loss of profit, revenues business, use, or other intangibles) whether or not such damages were foreseeable or if we had been advised of the possibility of such damages. You acknowledge and agree that by purchasing the Products you shall be solely liable for all claims, fines or penalties that arise, directly or indirectly, in connection with the products.
Release. You hereby generally release and forever discharge us and the Related Parties from any and all claims, debts, damages, liabilities, demands, costs, expenses, attorneys’ fees, actions and causes of action of every nature, known or unknown, relating to the manufacture, selection, delivery, sale, control, possession, use, operation, or maintenance of the products. It is the intention of the parties, that this release be and is effective as a full and final accord and satisfaction and release of all claims, debts, damages, liabilities, demands, obligations, costs, expenses, attorneys’ fees, disputes, actions, and causes of action of every nature, known or unknown, suspected or unsuspected, that you may have against us and the related parties relating to the manufacture, selection, delivery, sale, control, possession, or maintenance of the Products. The releases herein given shall be and remain in effect notwithstanding the discovery or existence of any such additional or different claims, facts, or legal theories.
These Terms of Sale (together with any Additional Terms) constitute the entire agreement between you and us with respect to the subject matter contained herein.
